(42) of Rule 18 of Chapter XVII of the Bombay High Court Appellate Side Rules, 1960, the order which is questioned in the present writ petition is a quasi judicial order, as not only there is an element of hearing offered to the parties concerned, including petitioner, but also the rights of the parties need to be adjudicated pursuant to the provisions of Rule 26(2)(iii) of the Maharashtra Employees of Private Schools (Conditions of Services) Rules, 1981. That being so, we are of the view that the matter lies before the learned Single Judge. 2) Mr. Anand Parchure, learned counsel appearing for the petitioner is granted time to address on the aforesaid issue, we also request learned counsel Mr.Jibhkate to assist the Court on the said issue.
