DATE : 13.01.2026 By way of present petition, the petitioners are seeking a direction to the respondent-Bank to return the original title deeds of the petitioners' property and to further direct removal of the charge/mortgage over the property in question from the revenue records, as the entire loan has already been repaid by the petitioners.

The petitioners have placed on record a copy of the "No Dues Certificate" issued by the Bank dated 27th June 2024, certifying that the petitioners have repaid the entire loan amount along with interest thereon to the Bank on 29th May 2024 and there is no outstanding against them. The petitioners repeatedly made correspondence with the Bank and even issued a legal notice; however, there is no response from the Bank. Hence, the present petition.

In the present petition, though notice was served upon the respondent-Bank long back in the month of June 2025, nobody appears on behalf of the respondent-Bank.

In light of the No Dues Certificate issued by the respondent-Bank in the name of M/s. C.P. Enterprises, the borrower certifies payment of complete loan amount along with interest and there is no outstanding amount remains to be recovered from the borrower, the respondent-Bank ought to have released the documents, namely, the original title deeds of the petitioners' property, and to remove the charge/mortgage over the said property.

In the circumstances, we direct the respondent-Bank to release the original title deeds of the petitioners relating to the property in question, i.e. Plot No.61, admeasuring 280.5 sq. mtrs., in New Sheet No.90, City Survey No.12447 (Old Sheet No.1, Block No.90), situated at Nazul Mohalla, Samadhipura, within the municipal limits of Chandrapur Municipal Corporation, within a period of four weeks from the date of production of this order. The respondent-Bank shall also take necessary steps to remove the charge/mortgage over the said property from the revenue records within above-referred four weeks time.

Accordingly, the petition is disposed of in above-referred terms. No costs.
