FEBRUARY 17, 2025 The contention is that before drawing an inference of the petitioner encroaching the government land, the respondent authorities ought to have referred to reports submitted by the Block Development Officer, Panchayat Samiti, Mangrulpir (Annexure - H) and by the Sub-Divisional Officer, Public Works Department, Mangrulpir (Annexure - J), which, according to the petitioner, indicate that the petitioner has not encroached upon the government land. Despite such status, the petitioner has been removed as Member of Gram Panchayat - Tarhala, Tahsil - Mangrulpir, District - Washim, in terms of Section 14(1)(j)(3) of the Maharashtra Village Panchayats Act, 1959.
2] On the strength of submissions made by the learned Counsel for the petitioner, issue notice to the respondents returnable on 10/3/2025.
3] The learned A.G.P. waives notice for respondent nos. 1 and 2.
