2025:BHC-NAG:1847 1 19-WP-922-2025.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH, NAGPUR.
WRIT PETITION NO. 922 OF 2025 SHANKAR S/O PUNJAJI KAWASKAR AND OTHERS Vrs.
AMANULLA KHAN NIYAMULLA KHAN DECEASED THROUGH LEGAL HEIRS AND OTHERS -------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order --------------------------------------------------------------------------------------------------------- Ms. Bhavana M. Kasare, Advocate for petitioners. CORAM: ANIL L. PANSARE, J.
DATE : 24/02/2025.
1.
Heard learned counsel for the petitioners for some time.
2.
Learned counsel for the petitioners, on instructions, seeks permission to withdraw the petition with liberty to file separate suit to challenge the Sale Deed dated 29/01/1970.
3.
To my mind, first request could be acceded to. Insofar as second request is concerned, if there is no legal impediment, the petitioners may file suit and for that purpose, liberty may not be required.
4.
With the above observations, permission to withdraw the petition is granted.
5.
Petition is disposed of as withdrawn.
