After the plot owned by the petitioner was regularized under the Maharashtra Gunthewari Developments (Regularisation, Upgradation and Control) Act, 2001, the prayer of the petitioner for grant of permission to erect the structure is informed to be rejected as per the communication dated 6-8-2019 in view of the pendency of PIL No.40 of 2013. 2.

The learned counsel for the petitioner would submit that the issue raised in this petition is no more res integra in view of the judgment of the Division Bench of this Court rendered on 14-2-2023 in Writ Petition No.8285 of 2022. 3.
