PC:- 1.
This petition takes exception to the order dated 11.10.2022 passed by the learned Industrial Court, Amravati in Miscellaneous Delay Condonation Application No. 2 of 2016. 2.
The petitioner herein has filed the complaint of Unfair Labour Practices Under Item 9 of Schedule IV of M.R.T.U. and P.U.L.P. Act, 1971 (for short "said Act"). By the order impugned, the learned Industrial Court has rejected the application filed by the petitioner in filing the said complaint. 3.
I have perused the order impugned. It appears that the petitioner was working with the respondents. He stood superannuated on 30.11.1998. The petitioner thereafter submitted an application for release of his retiral benefits. The Dinesh S. Sherla 1/2
31-cwp-1086-24.doc respondents rejected the said application by order dated 5.10.2001. It appears that the Additional Commissioner, Amravati by order dated 14.10.2002 had dismissed the appeal filed by the petitioner against the said order dated 5.10.2001. It further appears that even writ petition was filed before this Court and the same was not entertained.
4.
In view of the above and for the reasons recorded by the learned Industrial Court, I am not inclined to interfere with the order impugned. Hence, the Petition is dismissed. (N.R. BORKAR, J.) Dinesh S. Sherla 2/2 Signed by: DINESH SHERLA Designation: PS To Honourable Judge Date: 12/06/2024 16:47:55
