Advocate Mr. P.V. Ghare, appears for respondent No.7 (Kay Ann Mari Desa) and submits that he has instructions to appear on behalf of respondent No.7, who is residing in Canada. However, he seeks time of one week to file Vakalatnama on her behalf. 4.

Advocate Mr. Shareef, who appears on caveat for respondent No.1, points out that the controversy involved in the matter needs to be finally decided considering the advanced age of the parties. He also points out that the suit has reached at the stage of final hearing and at that stage, the application for recasting of issues is filed.
