The petitioner's caste claim as belonging to 'Chhatri' Scheduled Tribe was rejected vide impugned order dated October 4, 2024.

The petitioner has accepted the verdict delivered by the Committee and submits that since she is in the employment of the respondent - employer, the employer be directed to consider the absorption of her services on supernumerary post. 4.

As far as the aforesaid contention is concerned, we deem it appropriate to permit the petitioner to approach before the respondent No.3 within a period of two weeks from today with a request for absorption of her services on supernumerary post in terms of the existing policy of the State Government and the Service Rules of the respondent No.3.

Let the decision on the aforesaid representation be taken by the respondent No.3 within a period of eight weeks from the date of receipt of this order.

We hereby clarify that in case if the policy of the State Government and that of the Service Rules of the respondent No.3 so permit, the services of the petitioner can be absorbed on supernumerary post and the order of termination in such an eventuality be overlooked.

The petition stands disposed of in the above terms. No costs.
