The limited issue raised in the present Petition has been recorded in the order dated 27/02/2024 in Paragraph No. 1 as under:- "1.
The only issue involved is that when on the earlier two occasions consent to mortgage was granted by the Maharashtra Industrial Development Corporation, on a further application being made for consent, there is no response. It is contended that the Indian Bank has already made disbursement in advance and the compliance is to be done of the terms of the sanction, ....ANSARI ANSARI....
966wp1363.24 966wp1363.24 failing which, 1% penalty is being leviable and the threat for recall of the loan has been issued. It is contended that though substantial time has been lapsed since the request for consent was made on 07/08/2023 (pg. 228) in absence of any response, the working of the company would be adversely affected."
(2) Since that is the only plea and it is an admitted position that the Application for consent is pending with the Respondent No. 1 since 07/08/2023, it would be appropriate if the Respondent No. 1, considering the nature of the request, takes a decision upon the same all post-haste, considering which, the Petition is disposed of by directing the Respondent No. 1 to take a decision on the Application dated 07/08/2023 filed by the Petitioner, within a period of 15 days from today.
