Heard Shri A. R. Ingole, the learned counsel for the petitioner. 2.

The petitioner by approaching this Court seeks to challenge the impugned communication dated 28.12.2023 issued by the respondent no.2-Assistant Engineer-1(East), Nagpur Metro Region Development Authority (NMRDA), Nagpur, thereby requesting the Police Station Officer, Police Station, Kamptee, District Nagpur, for grant of police protection for demolishing the construction of the petitioner as referred in prayer clause (ii).

Being aggrieved by the aforesaid communication dated 28.12.2023 the petitioner has come with a prayer that the respondents be restrained from demolishing the construction of the petitioner. 4.

The present writ petition was filed on 09.01.2024 and is listed today, i.e. 11.02.2026 for admission that is after lapse of two years and as such, it has lost its efficacy as the date of the proposed action of demolition was 02.01.2024.

In that view of the matter, by efflux of time, the present writ petition has rendered infructuous and it is disposed of as such with liberty to the petitioner to approach this Court as and when the cause of action arises. No costs.
