During the examination of witness the documents verified by the Superintendent, Office of Assistant Charity Commissioner were tried to be exhibited, to which the respondents raised objection. Thereupon, the Assistant Charity Commissioner asked the petitioner to produce original documents. Then, the petitioner makes submission that once the documents were verified there is no need to produce the original documents.

This submission was rejected by the learned Assistant Charity Commissioner and insisted the petitioner to produce the original documents before exhibiting the verified documents. Such directions are the subject matter of challenge in this writ petition.

Learned counsel for the petitioner reiterated her submission which was made before the Assistant Charity
wp1657.24.odt 2/2 Commissioner that once the documents were verified there is no need to produce it. I do not find favour in this argument as the Court has every right to see the original documents even if it was verified at the time of filing the same.

In the circumstances, I do not find any error committed by the Assistant Charity Commissioner. Accordingly, the writ petition is dismissed. No order as to costs.
