Heard the learned counsel for the petitioner and the learned counsel for the respondent.

The learned counsel for the petitioner submits that the petitioner has approached this Court seeking challenge to the impugned notice dated 15.05.2018 issued by the respondent-sole, being contrary to the provision of the Section 53(1A) of the Maharashtra Regional and Town Planning Act, 1966 (for short 'the MRTP Act, 1966'). However, the learned counsel for the petitioner submits that after filling of the petition, the respondent is taking up the matter for regularization of the said construction. 3.

The petitioner had applied to the respondent for regularization of his construction and accordingly, he has deposited the construction charges for compounding under the MRTP Act, 1966 on 13.06.2018 and thus, the said nd.thawre

2/2 regularization is under consideration.

In view of the above, since nothing survives in the present petition, the petition is disposed of upon the request made by the learned counsel for the petitioner. 5.
