There was preliminary objection of maintainability of the petition by the learned learned Counsel for respondent, as there is remedy available to challenge the order of Lower Court passed in application under Order 39, Rule 4 of the Code of Civil Procedure. However, as petitioner restricts his claim only to the rejection of review. Both the parties agreed that the petition is maintainable, it will be heard on merit. 3.
