The petition challenges the order dated 07.11.2023 passed by the Collector, Washim in Review Application No.LNA/22/Karanja/ 150/95-96 decided whereby the Collector rejected the review application of the petitioner. 2.

The contention of the petitioner is that the Collector instead of enquiring the issue of adverse possession over land bearing Plot No.211 has conducted enquiry only in respect of land bearing Plot No.78/2 and wrongly mentioned as land bearing Plot no.211 as a corrected number of land bearing Plot No.78/2. In fact, the land bearing Plot No.78/2 was allotted to respondent no.4 and not land bearing Plot No.211. Whereas, the dispute is in respect of land bearing Plot No.211 wherein the petitioner is claiming to be in possession of said plot since last more than 60 years.

During the course of the arguments, it is revealed that a civil suit in respect of same plot was filed before the

27 wp1768.24.odt learned Civil Judge Senior Division, Mangrulpir, District Washim which has been disposed of and now lis is pending before the learned Additional District Judge, Mangrulpir, District Washim wherein one Dinesh Nagwani is party and claiming to have been allotted land bearing Plot No.211. 4.

In view of this, it is expedient to remand the matter back to the Collector for deciding afresh and to conduct enquiry in respect of land bearing Plot No.211 and also offer hearing opportunity to Dinesh Nagwani who was not party to the proceedings pending before the Collector. 5.

Thereby, the impugned order dated 07.11.2023 passed by the Collector, Washim is hereby set aside and the matter is remanded back to the Collector, Washim for deciding afresh on the issue of land bearing Plot No.211 only; that too after hearing Dinesh Nagwani.
