This petition takes exception to the order dated 24.11.2023 passed by the District Judge, Nagpur in Miscellaneous Civil Appeal No. 110 of 2022.

In a suit filed by the respondent Nos.1 to 3 herein for declaration and injunction against the petitioners, the trial Court by order dated 21.06.2023 granted interim injunction in Dinesh S. Sherla 1/2
926-cwp-1780-24.doc favour of the respondent Nos.1 to 3. The appeal filed by the petitioners against the order of trial Court came to be rejected by the order impugned.

Admittedly, there was no interim order in favour of the petitioners during pendency of the appeal and thus since last one year the interim injunction is operating against the present petitioners. In that view of matter instead of entertaining the present petition, it would be appropriate to direct the trial Court to decide the Suit expeditiously.

The trial Court shall endeavour to decide the suit being Regular Civil Suit No. 184 of 2022 as early as possible and in any case within a period of one year from the date of receipt of copy of this order.

The Petition is disposed of in the aforesaid terms. 6.
