Since the petitioner Nos.7, 9, 10, 12, 14 and 15 are retiring in the month of November/December, 2024, we direct that the pension case of these petitioners be processed treating them to have retired at the age of 60 years and to commence the payment of regular pension and other benefits on this basis. Same directions shall be applicable to the petitioner Nos.4, 11 and 13, who have retired in September/October, 2024.

Since the controversy is regarding the age of retirement whether it is 60 or 62, in case the petitioners submit an undertaking that they will not claim any benefits or entitlement for anything or any monetary dues, if the Court

39. WP 1810 of 2024.odt holds that the age of retirement is 60 years, the petitioners would continue to impart teaching without any emoluments of any nature whatsoever or for that matter any entitlement till they attain the age of 62 years, subject to the result of the petition.
