Reply-affidavit is filed on behalf of the respondent no.7, raising preliminary objection to the tenability of the petition.

Liberty is granted to the petitioners to join the concerned Department, from whom the work orders are issued, as party respondent. Amendment to be carried out forthwith.

Assistant Government Pleader Mr. H.D. Futane waives service of notice for the newly added respondent/Department.

Contention of the learned counsel for the petitioners is that the newly added respondent/Department

33. WP 1990 of 2024.odt issued work orders in favour of the petitioners and if the order impugned is continued, it will affect such work orders. 5.

It is made clear that the petitioners shall continue to carry out the work as per work orders, subject to the decision of the present petition, including preliminary objection raised by the respondent no.7. The petitioners shall not claim any equity. Similarly, on the basis of this order, the petitioners shall not claim any other relief with regard to the work orders.

Place the matter for further consideration on 16/04/2024.
