It is the case of the petitioner that without disclosing the date of illegal construction and particularly in absence of any pleadings that the petitioner carried out the construction during her term as a Councilor of Nagar Panchayat, Motala, or any such finding, the disqualification is bad in law.

Issue notice for final disposal to the respondents, returnable on 18/04/2024.

Shri Harshal Futane, learned A.G.P. waives notice for the respondent Nos. 1 and 2 and Shri A.P. Kalmegh, learned counsel waives notice for the respondent No.3.

The petitioner is permitted to serve the respondent No.4 by private mode, in addition to regular
2 19-WP2096-2024 mode of service, including service on the lawyer appearing before the trial Court and file affidavit of service by next date, failing which the petitioner shall deposit costs of Rupees Five Hundred with High Court Legal Services Sub-Committee, Nagpur.

In the meantime, there shall be ad-interim stay in terms of prayer clause (ii).

The office objections, if any, be removed before the returnable date.
