Shri V. N. Patre, learned counsel for the petitioners submits that though ten out of thirteen teachers who were declared surplus by the Education Officer vide impugned order are already relieved, the salary of the entire staff is withheld.

He would claim that in view of increase in the number of students that is 275 and 310 not only the three teachers who are not relieved but also some of the teachers who are relieved would be required to be brought back.
