Heard Mr. S.G. Zinjarde, learned counsel for the petitioner and Mr. S.R. Charpe, learned counsel for the respondent No.1.

Learned counsel for the petitioner submits that the authority who issued the chargesheet dated 11.10.2010, was not having power to do so on that day. He specifically raised the this issue in the complaint, but the same was not properly dealt by the learned Labour Court.

Therefore, without going into the other aspects of the matter, it is necessary to remit it to the learned Labour Court.

In view thereof, the present writ petition is partly allowed. The order dated 22.10.2019 passed by the learned Labour Court, Wardha in Complaint ULP No.31/2011 and order dated 11.12.2023 passed by the

2 20-WP-2332-2024.odt learned Industrial Court, Nagpur in Revision ULP No.6/2020 are hereby, quashed and set-aside. Learned Labour Court to decide the proceedings afresh by giving an opportunity to both the parties within a period of two months from today. No order as to costs.
