Mr. R.S. Kurekar, Advocate for petitioner.
Mr. Harshal Futane, AGP for respondent Nos.1 and 2. C ORAM : ANIL S. KILOR, J.
D ATE : 15 th APRIL, 2024.
1.
This matter pertains to disqualification of respondent No.3 as a member of Gram Panchayat Kurud, Taluka Wadsa, District Gadchiroli under Section 14(1)(j-3) of the Maharashtra Village Panchayat Act, 1958. 2.
At this stage, learned counsel for the petitioner makes a statement, on instructions, that he doesn't want press the challenge to the impugned order. However, it is prayed that, as the Additional Commissioner has remanded the matter back to the Collector for deciding the case afresh, the proceeding may be made time bound.
3.
Since the prayer made by the petitioner would not cause any prejudice to any of the parties if it is granted, I am of the opinion that even without issuing notice to the respondents the request can be accepted.
4.
Accordingly, the writ petition is disposed of. The Collector is directed to decide the application moved by the
wp2333.24.odt 2/2 petitioner under Section 14(1)(j-3) of the Maharashtra Village Panchayat Act, 1958 within three months from the next fixed date.
