ATE : SEPTEMBER 26 , 2024 Since the petitioner seeks a declaration that Section 10(4) of the Petroleum and Minerals Pipelines Act, 1962 is violative of Articles 14, 21 and 300A of the Constitution and a declaration is sought that it is unconstitutional being arbitrary, oppressive and unfair, we deem it appropriate to issue notice to the Attorney General of India, which is waived by Deputy Solicitor General of India on his behalf.
2) We expect the response from the Office of Attorney General of India within a period of six weeks from today. 3) As far as the merits of the petition are concerned, the contesting respondents are at liberty to file their affidavits and complete the pleadings within next returnable date, which is scheduled as 25/11/2024.
4) To be heard along with Writ Petition Nos.761/2024, 404/2024 and 1419/2024.
