Drawing support from the judgment delivered by the Division Bench of this Court at Aurangabad in Writ Petition No.2908 of 2016 on 18-7-2016 in the matter of Sangram S/o Ramdas Gholve and others Versus The State of Maharashtra and others, particularly Paragraph 12 thereof, the learned counsel for the petitioner would urge that the petitioner is entitled to compete for the post of Mechanic for which the qualification prescribed is possessing certificate from the ITI in Mechanical or Automobile stream. According to him, such candidates, who are holding either Diploma or Degree in Engineering, cannot compete for the said post, for the reason that the candidates, like the petitioner, who are holding the certificate from the ITI are not having any avenue or opportunity. The learned counsel would further claim that even otherwise there are independent posts of Junior Engineers in Mechanical and Civil advertised for which the requisite qualification is Diploma or Degree in Engineering.
