Heard the learned counsel for the parties.

It is contention of the respondent Nos.2 to 4 that selection grade is made applicable to the 20% of senior most teachers eligible in the list of seniority. The other aspects are also required to be considered. They are already prepared seniority list of primary school teachers and they are under process of preparing seniority list of secondary school teachers. Thereafter, the list of persons eligible for selection grade will be published. For this, the respondent Nos.2 to 4 require six months' time.

In our considered opinion, the petitioner if eligible to be granted selection grade, he will get the said benefit even if he stood retired. Accordingly, the petition stands disposed of KHUNTE

14-WP2887.24.odt 2/2 with a direction to the respondent Nos.2 to 4 to finalize the seniority list of secondary school teachers and also the list of eligible persons for grant of selection grade within a period of six months from passing of the order.
