The petitioner is challenging the order dated 28.07.2023 passed by the Sub-Divisional Officer, Arni, Dist. Yavatmal, whereby, the petitioner was directed to deposit an amount of Rs.3,00,000/- (Rupees Three Lakhs Only) towards penalty for empty vehicle, violation of earlier bond and alleged transportation of three brass sand illegally without royalty pass.

Learned counsel for the respondent/State submits that the petitioner has already availed an alternate remedy by filing an appeal, which is pending and in-spite of pendency of the appeal, same impugned order is being challenged by filing the present petition before this Court.

In view thereof, this petition is liable to be dismissed by imposing cost of Rs.50,000/- (Rupees Fifty Thousand Only) on the petitioner, which shall be deposited within a period of four weeks from today.
