The petitioner is disqualified in the wake of Section 14(1)(g) of the Maharashtra Village Panchayat Act, 1959 (For short, Act of 1959), owing to engaging the husband of petitioner under the order of the Grampanchayat. 2.

The counsel for the petitioner submits that the said work is under the MGNREGA scheme, as such, it cannot be inferred that petitioner has had interest either directly or indirectly by engaging husband in work under the order of Grampanchayat.

The fact remains that the scheme is implemented under the order of Grampanchayat and corresponding payments are also made to the person employed / engaged in such scheme, which include the husband of the petitioner, as such, petitioner has rather created direct interest by employing husband in a scheme implemented under the order of Grampanchayat. Therefore, the petitioner entails disqualification as contemplated under Section 14(1)(g) of the Act of the 1959.

Both the authorities i.e. Collector at first instance and the appellate authority have considered the factual aspect in its proper perspective while upholding disqualification of the petitioner, which does not warrant interference by this Court in a petition under Article 227 of the Constitution of India.

Resultantly, no error could be noted in the concurrent orders by the Collector, vis-a-vis, the Divisional Commissioner. Accordingly, the petition does not deserve any consideration. Resultantly, petition stands dismissed. No order as to costs.
