CORAM : M.W. CHANDWANI, J.
DATE : 25.03.2026.
1.
Writ Petition No. 2994/2024 was filed on the premise that the number of voters included in the voters' list of Respondent No. 25 - Housing Society exceeds the number of plots held by the society. Another objection is that certain names have been included in the voters' list, even though they do not appear in Form-I and Form-J as per the register maintained by the society. The last objection is that the inclusion of new members in the society has not been approved by the Assistant Commissioner of Social Welfare, Yavatmal.
2.
It appears that the petitioners approached before the respondent no.3 - Election Officer challenging the inclusion of names of respondent nos.4 to 24 in the voters' list, which came to be rejected on 02.04.2024. However, when the grievance was raised before respondent no.1, on the report of respondent no.2, the preparation of electoral roll was postponed due to stay which is reflected from the order of this Court dated 21.05.2024. It appears that the Administrator appointed for respondent no.25 has issued a program for finalizing the voters' list for the proposed election for 2026 to 2031 inviting objections on the provisions voters' list in the local newspaper 'Sakal' dated 15.03.2026.
3.
Learned counsel for the petitioners submits he will raise the objection before the Administrator / Election Officer as per the scheduled program of finalizing the voters' list. Since, a new program for finalizing of the voters' list has been published, the petitioners are at liberty to raise all these objections before the Election Officer. With these directions, the petition can be disposed of.
4.
Likewise, the petitioners in Writ Petition No.3061/2024 were aggrieved by non-inclusion of their names in the earlier voters' list. Since, the new program for finalizing the voters' list has been published as stated above, the petition can be disposed of with a liberty to the petitioners/their legal heirs to raise their objection before the Election Officer on the scheduled program of finalizing
the voters' list, since program invites objections on the proposed voters' list.
5.
Accordingly, both the writ petitions are disposed of. (M.W. Chandwani, J.) Wagh
