DATED : 30/01/2025 The petitioner in the present petition challenged the final voter's list contending that he was not considered as member though he is residing in 10 kms. vicinity of the Society. It appears that the election program is already declared.

The learned AGP pointed out that the condition of 10 kms. to be the area of operation is to register the new society. However, it is pointed out that the election of concerned society i.e. Matsya Vyavasayik Sahakari Sanstha Maryadit, Khadkai, Post Pangri, Taluka Malegaon, District Washim is governed the By-laws of the Society. As per the By-laws, the area of operation is limited to Patbhandhare Masla, Khadki, Ijara.

In view of this position, the petitioner's name in the voter's list is rightly rejected as they are not

2 53 wp 3021-2024 residing in the villages referred above. There is no reason to interfere in the same, as he is not residing in the area of operation of the concerned Society. Accordingly, the petition stands dismissed. No order as to the costs.
