The petitioner has challenged the order passed by the learned Maharashtra State Co-operative Appellate Court, Nagpur as well as the order passed by the Maharashtra State Cooperative Court, whereby the application for injunction filed by the petitioner against the respondent No.1 came to be rejected.

Learned counsel for respondent No.2 seeks time to file reply.

The order before the Cooperative Court, Nagpur rejecting the application for grant of injunction is on the basis of sale-deed. Learned counsel for petitioner has pointed out that though the respondent No.1 has claimed possession over the suit property on the basis of sale-deed, he is abandoning the claim, as the suit filed by him is unconditionally withdrawn.

Issue notice to the respondents.

The respondent no.1 is restrained from creating third party interest in the suit property, and changing the nature of property till next date.
