(2) The Petition can be disposed of as the offer made by the Respondent No. 3 - Dean thereby accommodating the Petitioner's candidature at Government Medical College & Hospital, Aurangabad, as an Assistant Professor in Urology Department, is accepted by the Petitioner.

(3) The Petitioner claims that he was ready and willing to join the duties from the date his candidature was sponsored at GMC, Akola, however, it was because of the failure of the Respondent No. 3, the Petitioner was not permitted to join. (4) In such an eventuality, Mr. Godbole, learned Counsel appearing for the Petitioner has urged that the aforesaid ....ANSARI ANSARI....

15wp3093.24 15wp3093.24 waiting period from the date of his recommendation i.e. 27/02/2024 for making him join at the Urology Department of GMC, Akola in the capacity of the Assistant Professor be considered for the purpose of discharge of bond period. (5) Since the Petitioner is willing to join at Akola, we deem it appropriate to dispose of the Petition by accepting the statement made by Mr. D.V. Chauhan, learned Government Pleader that the Petitioner shall be permitted to join in the very same capacity at GMC, Aurangabad. He has tendered a communication issued by the Respondent No. 2 which is taken on record and marked as 'X' for identification. (6) As far as the alleged period of waiting, as has been claimed by the learned Counsel for the Petitioner i.e.

from 01/03/2024 till he joins at Aurangabad can be considered for the purpose of discharge of bond period, is concerned, we permit the Petitioner to move before the Competent Authority i.e. Respondent No. 2 - Director of Medical Education & Research, who shall, upon receipt of such request being made by the Petitioner, take decision in the matter and communicate the same to the Petitioner within a period of eight weeks.
