The petitioner has challenged the order passed by the Additional Collector dated 29.4.2024 disqualifying her from the post of Sarpanch.

Issue notice to the respondents returnable 11.6.2024.

Mr. J.Y. Ghurde, learned A.G.P. waives notice for respondent Nos.1 and 2.

Mr. P.S. Kshirsagar, learned Counsel waives notice for respondent No.4.

The learned Counsel for respondent No.4 has stated that the post of Sarpanch has become vacant. She is removed from the post of Sarpanch but she is not disqualified as a member.

The petitioner is challenging the order of disqualifying her for not holding Gramsabha in the month of August. She has submitted all the documents to show that the Gramsabha was held in August 2023. The earlier complaint was lodged by one Karim Shaha and she has submitted all the documents before the Sub-Divisional

2 wp3160.2024 Officer thereafter similar complaint was lodged by respondent No.4 before the Additional Collector and she has again submitted all the documents showing that meeting was held in August 2023. Respondent No.4 has made submission that the post has become vacant which is denied by the petitioner. The learned Counsel for the petitioner has made submission that the said order was received by petitioner on 10.5.2024 hence she is still on the post of Sarpanch, considering the circumstances status quo as on today is granted till the next date of hearing.
