The grievance of the petitioner who is not even the owner of the property was that the order passed under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 was implemented by the bailiff of the Court with the assistance of Police Station Officer. 3.

The order passed below Exhibit-1 in Criminal M. A. No.3326/2023 dated 03/08/2023 is at record page 35, Annexure-C. The contention of the petitioner was that the aforesaid action was without any power in law and hence was illegal and the present writ petition was filed seeking challenge to the aforesaid action of bailiff and the Police Officer.

The present petition was listed only once on 19/12/2023. Thereafter is has never seen the light of the day and was listed for the first time before this Court on 10/03/2026. On 10/03/2026 none appeared for the petitioner. Hence, the petition was kept today in order to give one opportunity to the petitioner to appear before this Court. Today also when the matter is called out, none appears for the

Even otherwise, the issue involved in the present writ petition has been rendered infructuous and accordingly, the writ petition is disposed of as infructuous.

No costs.
