During the course of hearing it is sought to be argued on behalf of the learned Counsel for Petitioner that the application dated 20/5/2024 (P.108) was sought to be moved before the execution court, however, since it was not entertained, the Petitioner was compelled to file this Petition. 2.

This Court has already heard submissions of the learned Counsel for both sides on merit of the Petition. In order to ascertain as to the factual position in this regard, the execution court is directed to submit the report as to whether any such application was ever moved and it was refused to be entertained. 3.

Report be placed before this Court on the next date of hearing.
