The only controversy is that though the Petitioner has applied for the post of Gas Cutter, in terms of the advertisement dated 06.06.2023 (page 25) for which clause 3.1 (page 26), mandates that a National Trade Certificate issued by the National/State Council for Vocational Training is mandatory, the Petitioner has submitted a State Certificate which indicates the Petitioner having passed the trade of Welder.

It is further contended, that the course of Gas Cutter is an integral part of the curriculum of the course of Welder which the Petitioner has passed. It is further contended, that though one Diksha Jitendra Hirekhan, was

2 913.WP.3315-2024.odt also short listed, who was a Welder she has been permitted, to undergo apprenticeship, of the trade of Gas Cutter. 4.

It is contended, that the trade of Welder is different from that of a Gas Cutter for which the advertisement itself, is being pressed into service. 5.

The Respondent to file the submissions, clarifying this position on record.
