This Petition takes exception to the order dated 26.04.2024 passed by the learned District Judge-2, Gondia in Misc. Civil Appeal No. 21/2020.

The Respondents herein (original Plaintiffs) had filed a suit for perpetual injunction against the present Petitioner (original Defendant). The Trial Court vide order dated 24.07.2020 (page 57) granted interim injunction in favour of the Respondents and the same is confirmed by the order impugned. Hence, this Petition.

It appears that, the suit is at the stage of evidence. Considering the facts and circumstances, instead of hearing this Petition on merit, it would be appropriate to direct the

2 2.WP.3354-2024.odt learned Trial Court to dispose of the suit expeditiously. Accordingly, the following order is passed.

ORDER

The learned Trial Court shall endeavour to decide the R.C.S. No. 10/2020 as early as possible and in case within a period of nine months from the date of receipt of the copy of this order.

The Petition is disposed of in the aforesaid terms. No costs.

Pending application/s, if any, shall stand disposed of accordingly.
