Dhawas, learned counsel for the petitioners fairly states that the District Court is hearing the Miscellaneous Civil Appeal finally, hence, seeks permission for withdrawal of the present petition. Accordingly, the same is permitted to be withdrawn, however, this will not preclude the petitioners from agitating all the points before the District Court in Miscellaneous Civil Appeal and the appellate Court shall independently decide the appeal on its own merits.
