IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

WRIT PETITION NO.3636 OF 2024 (Smt. Savita d/o Vasantrao Khadse .vs. Central Government of India and others) __________________________________________________________________________ Office Notes, Office Memoramda of Coram, appearances, Court's orders of directions Court's or Judge's orders.

and Registrar's Orders.

Smt. S.W. Deshpande, Advocate for petitioner, Shri C.J. Dhumne, Advocate for respondent nos.1 to 6. ........

C ORAM : NITIN W. SAMBRE AND ABHAY J. MANTRI, JJ. D ATE : 23.07.2024.

Not on board. Taken on board.

2.

The challenge in the petition is to the orders dated 28th May, 2024, 31st May, 2024, 3rd June, 2024 and 3rd July, 2024.

3.

This Court has in detail dealt with the status of the petitioner as that of a contractual employee in the order dated 20th June, 2024 and granted interim relief as the petitioner's services were sought to be terminated.

4.

In the interregnum, the respondents have issued an order to the petitioner, who is admittedly occupying the post on contractual basis for last 17

916wp3636.24.odt 2/2 years and asked her, vide order dated 3rd July, 2024, to join at headquarter Dehradun for discharge of her duties.

5.

As such, the petitioner's services are sought to be continued and the order of termination is informed to have been already stayed as could be inferred from the communication dated 3rd July, 2024.

6.

The petitioner being a contractual employee cannot as of right claim that she should be permitted to serve at a particular place only. 7.

In the aforesaid background, we are of the view that since the order of terminating the petitioner is already stayed and she is now allocated the work at Dehradun, there is no reason to cause interference in the extra-ordinary jurisdiction. The petition accordingly stands disposed of.
