The learned counsel for the petitioner submits that after the land acquisition, the sale deed was executed in favour of the petitioners and the possession was handed over by a separate possession receipt. Despite the same, Exh.5 was allowed against the petitioners and it was maintained by the Appellate Court without considering the above referred fact.

Issue notice for final disposal to the respondent, returnable after two weeks.

The Petitioners are permitted to serve the respondent by private mode, in addition to the regular mode of service, including service on the learned lawyer appearing before the trial Court and file an affidavit of service by next date, failing which the petitioners shall deposit costs of Rupees Five Hundred with High Court Legal Services Sub-Committee, Nagpur. 5.

The Office objections, if any, be removed on or before the returnable date.
