Shri P. S. Kshirsagar, learned counsel for the petitioners submit that the petitioners have approached this Court seeking challenge to the order dated 21/12/2022 passed by respondent No.3-Special Land Acquisition Officer and Deputy Collector, Bembla Project, Yavatmal thereby rejecting the application filed by the petitioners-land owner under Section 28A of the Land Acquisition Act, 1894 (hereinafter referred as 'the said Act') . 3.

On the basis of judgments dated 04/03/2022 in LAC No.151/2017 (Sunil Madanlal Lohiya and anr. Vs. The State of Maharashtra, Thr. Collector, Yavatmal and ors.) and LAC No.03/2017 (Anusaya Suresh Punde vs. The State of Maharashtra, Thr. Collector, Yavatmal and ors.) passed by the learned Joint Civil Judge (S.D.), Yavatmal under Section 18 of the said Act, the contention is that the aforesaid order dated 21/12/2022 is passed without considering the reported judgment of this Court in case of Motiram Zingar Wawre vs. State of Maharashtra and ors. 2017 (4) Mh.L.J. 627. The impugned order dated 21/12/2022 is at record page 201 Annexure-6.

4. Perusal of the aforesaid order reveals that the application under

20/21 Section 28A has been rejected solely on the ground that the petitioners have received an amount as rehabilitation compensation. Learned counsel for the petitioners relied on the judgment passed by this Court in Writ Petition No.2495/2023 (Gunwanta Maroti Mohod and ors. vs. State of Maharashtra and ors.) wherein this Court held that rejection of application under Section 28A of the said Act is incorrect as the provisions of Section 28A of the said Act seek to bring about a parity in the matter of grant of compensation so as to do away with any claim of discrimination on that ground. Relying on the judgment passed by this Court in case of Motiram (supra), this Court allowed the said writ petition and directed the Special Land Acquisition Officer to decide the entitlement of the petitioners afresh under Section 28A of the said Act.

5. Shri M. A. Kadu, learned counsel for respondent No.4-Acquiring Body placed reliance on the judgment passed by this Court in Writ Petition No.4199/2024 (Dilip Sheshrao Nagpure and ors. vs. State of Maharashtra and ors.) wherein the judgment in Writ Petition No.2495/2023 has also been considered. In the said matter, it is held that the amount of rehabilitation compensation awarded earlier should be considered while awarding the compensation under Section 28A of the said Act, provided that the compensation received under the rehabilitation has to be adjusted with the compensation under Section 28A of the said Act, if granted earlier.

The petitioners have no objection to dispose of the present petition in view of the proposition laid down in the judgment passed by this Court in Writ Petition No.4199/2024.

Hence, we proceed to pass the following order : (i) The writ petition is allowed.

(b) The impugned order dated 21/12/2022 passed by the respondent No.3-Special Land Acquisition Officer and Deputy Collector, Bembla Project, Yavatmal is hereby quashed and set aside. (c) The respondent No.3-Special Land Acquisition Officer and Deputy Collector, Bembla Project, Yavatmal is directed to decide the claim of the petitioners within a period of two months from today.

(d) The respondent No.4-Acquiring Body shall adjust the amount awarded towards rehabilitation while granting compensation under Section 28A of the Land Acquisition Act, 1894. 8.

Rule is made absolute in above terms. Writ Petition is disposed of. No order as to costs.
