(2) Learned Counsel for the Respondents raised a preliminary objection that considering the prayers in the Writ Petition, there is no order under challenge to invoke the jurisdiction of this Court under Article 227 of the Constitution of India. It also appears that the present Petitioner had already filed Writ Petition No. 2185/2024 before the Division Bench under Article 226 of the Constitution of India which came to be dismissed on 01/07/2024 on the ground that the Respondent Nos. 2 and 3 against whom the relief is sought cannot be termed as 'State' within the meaning of Article 12 of the Constitution of India. Accordingly, the Petition was disposed of with liberty to the Petitioner to agitate its claim before the Competent Authority.

There is no order under challenge as to entertain this Writ Petition under Article 227 of the Constitution of India in view of the Chapter I, Rule 2 and Chapter XVII Rule 18 of the Bombay High Court Appellate Side Rules, 1960. As such, the Writ Petition is not maintainable. (4) Accordingly, the Writ Petition stands dismissed as not maintainable, however, liberty is granted to the Petitioner to take appropriate Proceedings available in law. Pending Application(s), if any, stand(s) disposed of.
