The petitioner seeks challenge to the communication dated 4.4.2024 issued by the Sub Divisional Officer, Akot i.e. respondent no.3, thereby directing the present petitioner to deposit 25% of the amount challenged in the Appeal under Section 247 of the Maharashtra Land Revenue Code, 1966.

The contention is that, the petitioner had approached to the learned S.D.O., Akot seeking challenge to the impugned order dated 15th March, 2024 passed by the Tahsildar, Akot under Section 48 (7) of the Maharashtra Land Revenue Code, thereby imposing the penalty of Rs.1,02,40,000/-. The petitioner after filing such Appeal had requested the learned S.D.O. Akot to stay the aforesaid order dated 15.3.2024 as the aforesaid orders stipulated that the amount of penalty should be deposited on or before 30th March, 2024,
2 38 wp4485.2024.odt otherwise, the aforesaid procedure for recovery of the aforesaid amount will be initiated.

The impugned order refers to the Government Resolution dated 1st March, 2017, thereby directing the Authority that when such stay to an order directing the amount to be deposited in favour of the Government is sought then in such matters, the stay shall be granted subject to the condition of depositing 25% of the amount challenge. Thus, no fault can be found with the impugned order dated 4.4.2024 passed by the learned SDO.

In view of the above, present writ petition is disposed of, with a direction to the respondent no.3 - SDO, Akot to decide the Appeal filed by the Petitioner under Section 247 of the Maharashtra Land Revenue Code, 1966 within a stipulated period on its own merits and in accordance with law within a period of six months from the date of production of the order of this Court.

Writ Petition is accordingly disposed of.
