The learned counsel for the petitioner submits that though the project of road widening was going on, contrary to the public interest, the injunction was granted to taking possession and on filing the appeal since there was delay of 252 days, the same came to be rejected.

It is submitted that the because of rejection of the delay application, the project has been halted.

In the circumstances, issue notice for final disposal to the respondents, returnable after two weeks.

5.

The Petitioner is permitted to serve the respondent by private mode, in addition to the regular mode of service and file an affidavit of service by next date, failing which the petitioner shall deposit costs of Rupees Five Hundred with High Court Legal Services Sub-Committee, Nagpur.

6.

The Office objections, if any, be removed on or before the returnable date.
