The learned Counsel for the petitioner submits that the petitioner, without prejudice to his rights is willing to deposit the amount of penalty imposed by the Tahsildar and 50% of penalty amount imposed by the Sub-Divisional Officer. It is submitted that subject to the said deposit, the vehicle in question be released as the livelihood of the petitioner is dependent upon the said vehicle. iii.

The total amount of penalty is Rs.1,20,600/-. In the facts and circumstances, the respondent no.4 Tahsildar, Pauni shall release the vehicle in question, subject to deposit
