ATE : APRIL 07, 2025 1) The petitioners claims to be governed by the Old Pension Scheme, however, in terms of the opinion of the learned Full Bench in Bhagwan Dilipkumar Deshmukh vs. The State of Maharashtra reported in 2019(3) Mh.L.J. 903, the institution in which the petitioner was working as an 'Assistant Teacher' has to be receiving 100% grant in aid. 2) Para 3 of the petition itself contains an averment that the School has received 100% grant in the year 2017. That being the case, the matter is squarely covered by the decision of Full Bench in Bhagwan Deshmukh (supra). The petition is therefore dismissed. No costs.
