It is contended that petitioner no. 2, being the sister of deceased Dinesh, has the right to claim the appointment on compassionate grounds. Her application was rejected because the claim of the deceased's widow superseded the petitioner's right to claim a compassionate appointment. As against, the learned Advocate has canvassed that on 11.04.1990, the wife of the deceased Dinesh, left the house and is living separately. She has initiated criminal proceedings against her in-laws. She does not maintain the petitioner no.1-mother-in-law. He has drawn support from the judgment in the case of Shimla d/o Late Satiram Rajbhar and another vs. Western Coalfields Limited, Saoner and others, as well as on the order passed by this Court in Writ Petition No.6841/2023 dated 17th October, 2023. 3.
As such, issue notice to the respondents, returnable on 20th September 2024.
