It is the contention of Shri P. S. Kadam, learned counsel appearing for the petitioners that the services of petitioner No.3 were already approved on a post from where he has been transferred and that being so the post on which he is transferred being also admissible to 100% grant-in-aid, no additional burden was created on the public exchequer. The learned counsel would urge that the issue is covered by the order of this Court in Writ Petition No.301/2023 (Ku. Manda Udebhanji Choudhari (Sau. Manda W/o Vivek Tarange) vs. State of Maharashtra and ors.) decided on 26/06/2023. 3.

Issue notice to the respondents for final disposal of the writ petition, returnable on 04/09/2024.

Learned Additional Government Pleader Shri S. M. Ukey waives service of notice for the respondents.

Till then, it will be appropriate in our opinion to observe that the respondent No.2-Deputy Director of Education and the Education Officer shall release the salary to which the petitioner is entitled.
