The learned Assistant Government Pleader seeks further time to take instructions. At his request, list the petition on 4th December, 2024.

The learned counsel for the petitioner submits that the vehicle of the petitioner is lying idle in the custody of the respondent. It is submitted that the petitioner, without prejudice to his rights is willing to deposit the amount of penalty imposed by the Tahsildar and 50% of the penalty amount imposed by the Sub Divisional Officer. It is submitted that subject to the said deposit, the vehicle in question be released as the livelihood of the petitioner is dependent upon the said vehicle.

The toal amount of penalty is Rs.1,04,000/-. In the facts and circumstances, the respondent no.2 Tahsildar, Mangrulpir, District Washim shall release the vehicle in question, subject to deposit of Rs.75,000/- by the petitioner with the office of the Tahsildar, Mangrulpir, District Washim.
