Learned counsel for the petitioner pointed out that in the earlier round of litigation i.e. Writ Petition No. 9099 of 2009, this Court by order dated 27th October, 2023 granted liberty to the petitioner to make an application to the respondent for refund of fees. Accordingly, respondent was also directed to take decision on the said application, if made in accordance with the law. 2.

It reveals from the record that petitioner on 2nd December, 2023 made representation to the Commissioner, State Excise, Mumbai SKNair

915-wp-5016-24.odt who is respondent no.2 in the present petition. It is informed that till date said representation is not decided by the respondent no.2. Hence, respondent no.2 is directed to take decision on the pending representation dated 2nd December,2023 within a period of two weeks. 3.
