DATE :- 30th SEPTEMBER, 2024 By placing reliance on the decision delivered by this Court in Govind Phulsing Rathod vs. Education Officer (Secondary), Akola Zilla Parishad, and others in Writ Petition No. 2034 of 2019 on 6th September, 2022, learned counsel Mr. N. B. Rathod, representing the petitioner, urged before us that his case is squarely covered by the aforesaid decision and he seeks a declaration for the entitlement of full pension by setting aside the order impugned dated 9th March, 2020 which refused to condone the break of around twenty years on the ground that the services rendered is less than ten years. To be precise, nine years and six months.

Mr. N. S. Rao, learned Assistant Government Pleader waives service of notice for respondent nos. 1 and 2. Issue notice to respondent no.3 by making the same returnable on 14th November, 2024.

In addition to the Court notice, notice to respondent no.3 by private mode is also permitted.
