Shri Kalwaghe, learned counsel fairly concedes that the alternate remedy as is available in law will be prosecuted. In the light of the Judgment rendered by Hon'ble Apex Court in the case of Gurudassing Nawoosing Panjwani Vrs. The State of Maharashtra and others, the delay occurred in filing the petition shall be considered. The time spent in prosecuting the petition can be taken into account by the concerned authority. 2.

Since the interim order is operating, the same shall operate till the petitioner approaches the authority within a period of four weeks from today and it will continue for two weeks thereafter.

In view of the above, petition is disposed of. 4.
